What Is CDPAP?

CDPAP, or the Consumer Directed Personal Assistance Program, is a vital Medicaid-funded initiative in New York that provides a personalized approach to long-term care for individuals facing chronic health conditions or disabilities. What sets CDPAP apart is its emphasis on consumer choice and control.


At its core, CDPAP allows eligible individuals to become the architects of their own care. Instead of being assigned a care provider, they have the power to select their personal care assistant, whether it's a family member or a trusted friend.


The program also offers financial flexibility, with payments and benefits administered by a fiscal intermediary, ensuring compliance with Medicaid regulations and state laws. This system allows individuals to focus on their health and well-being while someone else handles the administrative aspects.

Eligibility for CDPAP

To be eligible for CDPAP benefits, you must meet the following criteria established by the State of New York:

  • Medical Assistance Eligibility: The individual must meet the standard for medical assistance eligibility.
  • Long-Term Care Services: They should be deemed eligible for long-term care services.
  • Stable Medical Condition: The individual must have a medical condition classified as "stable."
  • Self-Directing Capability: They should be capable of acting as a self-directing entity, or they can have a designated representative who can do so on their behalf.
  • Need for Care: There must be a need for services provided by a personal care aide, home health aide, or nurse.
  • Responsibility Fulfillment: The individual must be willing and able to fulfill all responsibilities themselves or have a representative who can manage these responsibilities.
  • Participation in Assessment: They should be able to engage in the assessment or reassessment process as required.

Initiating CDPAP Services with a Physician's Order

To kickstart CDPAP services, the patient must undergo an evaluation by an authorized medical professional. This could include a doctor, a physician’s assistant, or even a nurse practitioner. Once the assessment is complete, the Physician's Order for long-term care services must be submitted to the appropriate social services administration office within the next 30 days. Both the medical provider and the patient can do this.

Social Assessment

After receiving the Physician's Order, a social services organization will conduct a social assessment. Usually, this takes the form of a short interview with the patient or their chosen representative. The whole point of this assessment is to see how willing the patient is to participate in their care, as well as what sort of informal support they already have from family members or friends.

Nursing Assessment

The nursing assessment is carried out by a licensed and registered nurse in New York and involves evaluating what the patient's long-term care needs are from a medical standpoint. This might involve showing how they perform certain tasks or any other form of effective communication so that the nurse can assess if the patient can tell their provider what they need help with.

Assessment Authorization

Once the individual is deemed eligible for CDPAP services, the district authorizes the scope of services, hours, and frequency of care. This ensures that the care plan aligns with the consumer's medical needs as well as those identified in the assessments. In some cases, CDPAP services may be approved even if the patient is already receiving other services concurrently.

Reassessment: Keeping Care on Track

Before the end of an authorized care period, the consumer or their representative must participate in the reassessment process. Reassessment addresses several key questions:

  • Has the existing authorized care plan met their needs thus far?
  • Is the consumer still medically eligible for CDPAP services?
  • Have there been any changes in the informal support the consumer receives?
  • Has the consumer's medical condition changed in a way that necessitates a new assessment?

Significant changes in the consumer's medical condition often require a new physician's order, social assessment, and nursing assessment. For example, if the person's condition deteriorates to the point where they can no longer make informed decisions independently, these assessments may be redone with a new representative acting on their behalf.

Consumer Responsibilities

Consumers manage their CDPAP care plan. This includes administrative tasks such as maintaining accurate timesheets, handling payroll, and assessing the quality of services received. However, if preferred, the financial aspects can also be administered through a fiscal intermediary.

Can Family Members Serve as Personal Care Assistants?

A common question many consumers have is whether their family members can act as their personal care assistants and receive financial benefits through Medicaid via CDPAP. According to New York State law, parents of adult children over 21 years of age can be eligible for CDPAP aide compensation. However, spouses are not eligible, and parents who are already acting as their child's representative cannot receive compensation.
